Pick Up Service Agreement
1. GENERAL
Pick UP Edinburgh offers the Services available at pickupedinburgh.com and/or services via business partners.
"Service" is one of the services fulfilled to transfer passenger(s).
"User" under the terms and conditions described a person agreeing to use one of our services.
"Agreement" is 2 way mutual confirmation to accept terms and conditions and following rules described in this page.
2. By booking one of our Services, the User shall be deemed to have accepted the terms & conditions without any reservations, exceptions or limitations not contained here.
3. Company reserves the right to change or modify this Agreement at any time and in its sole discretion and with no prior notice. A new version of this Agreement shall come into effect when posted on the Site. By continuing to use the Service, the User confirms the User's acceptance of the revised Agreement. The Company encourages the Users to review the Agreement frequently to ensure that the User understands the terms and conditions that apply when he uses the Service. If the User does not agree to the revised Agreement, the User may not use the Service.
4. This edition of the Agreement enters into force on November , 2023 and is effective until the following version is published.
5. Any time frames specified in this Agreement shall be determined by the UTC+0 time zone, unless otherwise. The beginning and the end of calendar dates is sourced from AD Calendar.
DESCRIPTION OF SERVICE
1. The Service grants the User access to the data for searching for private and other transportation service on pickupedinburgh.com . Ability to register as returning customer , book or contact company with any enquiries.
2. After search/registration User obtains access details for trip details , users reserves to right to book or leave the site without booking.
3. In the Personal Account the User is able to search a vehicle for trip , check historical trips and change user details.
4. During booking user is obligated to provide all necessary details for company to able to complete the trip.(including the start date and time, route or amount of time for vehicle rent if applicable, vehicle class, number of passengers, availability and amount of luggage, availability of child safety seats, availability of additional services in the car, etc.).
5. If the provider agrees to fulfil additional services for a certain Requests, sends to the "Offer" via booking , writing or verbal contact.
6. If the Driver refuses to provide the services under the terms and conditions that have been agreed between them and the User the Transportation Contract is considered terminated by the Driver and other Driver may be sent as a response to this respective User's Request.
7. The terms of cancellation of the Transfer by the User, including the terms and procedure of the refund of the cost of the Transfer in case of its cancellation by the User ;
7.1 The User acknowledges and agrees that: The User's ability to obtain transportation Service through the use of the Service does not establish the Company as a provider of the transportation Service . When the User finds a offer and accepts its terms including the condition of a specific Transfer and Transfer Price, he shall enter into a Transportation Contract with the Company.
7.2. The Users may receive transportation services using the Service all by themselves only if they reached the age of majority under the laws of the UK Government. Persons who have not attained this age may not use the Service independently, but may participate in Transfers accompanied by adults .
7.3. Due to the nature of the Service provided under this Agreement, the liability of the Company is limited to an obligation to accurately fulfil transfer via one of approved drivers.
7.4. As well as to transfer prepayment or full payment for a specific Transfer received from the User to the driver.
8. The Company shall not be liable for the credibility of the information passed as well as for the due and in good faith performance of the Driver`s obligations within any agreements between the Driver and the User.
9. The Company bears no responsibility for any losses including the loss of gains and physical losses and damages in any way determined by the use of the Service.
10. The Service, the software used for the provision of the Service and other content of the Site through which the Service are available , Pick UP logo and other logos and registered trademarks are protected by the Company’s or third parties intellectual property rights.
10.1. The User is hereby granted a limited, non-exclusive, non-transferable license to: access and use the respective intellectual property solely in connection with the User's use of the Service.
10.2. Access and use any content, information and related materials that may be made available through the Service, in each case solely for the User’s personal, non-commercial use. Any rights not granted are reserved by the Company.
10.3. There may certain technical limitations, restrictions and delays on the Service, which can lead to the inaccessibility of the Service which might be due to some reasons beyond the Company’s control.
10.4. The User enters into this mutual Agreement at its own risk and that the Service and any information provided to the User are provided "as it is" .
11. In case of violation by the User of the provisions of clause of this Agreement the Company has the right to suspend User's access to the Service, as well as the payment of any completed trips.
12. Company has the right to terminate this Agreement as provided in section 12.1. The relations between the User and the Company fall exclusively within the Agreement contained .
Nothing shall be presumed to indicate that the Company and the User have entered into or have agreed to enter into any other contract or have any rights and obligations before each other within any other agreement.
13. The User pays to the Company a Trip fee during booking process . This is one fee which includes all costs , tax's , tolls etc.
14. Price of the trip can not be changed after booking unless a level of service is changed , added or removed within agreed service terms.
15. For cancellations by user full refund to be provided up until 24 hours before trip date . If cancellation request is within 24 hours of trip, no fee will be refunded.
16. For airport pick ups we have responsibility to track your flight and pick you up if your flight is early or late up to 2 hours difference , otherwise we hold the right to cancel / re schedule booking with extra charge for drivers lost time. We will wait for you free of charge up to 1 hour after flight is landed. If your arrival exceeds 1 hours charges apply. Please see below.
17. Waiting times as follows ;
Airports , up to 1 hour free then £10 charge per 15 mins
Train Stations , up to 15 mins free then £10 per 15 mins
Any other addresses , up to 15 mins free then £10 per 15 mins
18. Type of vehicle is to be provided as requested , no smaller class however bigger class might be sent with no extra charge to customer.
